1. Acceptance of Terms

By accessing or using SitePulsar ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These terms constitute a legally binding agreement between you and SitePulsar.

2. Description of Service

SitePulsar provides AI visibility audit services that analyze publicly available website data to generate Generative Engine Optimization (GEO) and Agentic AI Optimization (AIO) reports. The Service evaluates brand visibility across AI engines including ChatGPT, Claude, Gemini, Perplexity, and Grok, and assesses website readiness for AI agent interactions.

3. AI-Generated Content Disclaimer

In accordance with the EU AI Act (Regulation 2024/1689), we inform you that:

• Audit reports are generated using artificial intelligence systems, including models from Anthropic (Claude) and OpenAI (GPT).
• AI-generated scores, analyses, and recommendations are informational in nature and should not be considered as professional advice.
• Results may vary over time as AI engines update their knowledge bases and algorithms.
• We do not guarantee the accuracy, completeness, or timeliness of AI-generated content.
• Users are responsible for independently verifying any recommendations before implementing changes to their websites.

4. Acceptable Use

You agree not to:

• Use the Service to audit websites you do not own or have authorization to analyze.
• Attempt to circumvent rate limits, usage restrictions, or security measures.
• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Resell, redistribute, or sublicense the Service without written consent.
• Submit malicious URLs or content designed to exploit the Service or third-party AI providers.

5. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

6. Intellectual Property

The Service, including its design, code, algorithms, and branding, is the intellectual property of SitePulsar. Audit reports generated for your websites are licensed to you for your own use. You may share your reports but may not misrepresent their origin or remove SitePulsar branding.

7. Third-Party Services

The Service relies on third-party AI providers (Anthropic, OpenAI) and infrastructure providers (Supabase, Vercel). We are not responsible for outages, changes, or limitations imposed by these third-party services. The availability of certain audit features may depend on the continued availability of these third-party APIs.

8. Limitation of Liability

To the maximum extent permitted by law, SitePulsar shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

We are not liable for any business decisions made based on AI-generated audit results, including but not limited to website modifications, SEO changes, or strategic decisions derived from our reports.

9. Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may request export of your data before termination.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands and applicable European Union regulations, including the GDPR and the EU AI Act. Any disputes shall be submitted to the competent courts in the Netherlands.
